VI. LOS MEDIOS PARA EJERCER LOS DERECHOS DE ACCESO, RECTIFICACIÓN, CANCELACIÓN U OPOSICIÓN (POR SUS SIGLAS ARCO) AL TRATAMIENTO DE DATOS PERSONALES.
Usted puede ejercer sus derechos de acceso, rectificación, cancelación u oposición de sus datos personales, por sus siglas ARCO, presentando una solicitud de conformidad con el siguiente procedimiento: Presentar un escrito dirigido al Encargado de Protección de Datos Personales vía correo electrónico a: info@peninsula.mx, cuyo domicilio está en Av. Los datos que debe contener y los documentos que debe anexar a su solicitud, son:
a) El nombre del titular de los datos personales:
b) El domicilio del titular y, es su caso, el domicilio
del representante legal;
c) Un medio alterno para comunicarle la respuesta a su solicitud;
d) Los documentos que acrediten la identidad del titular de los datos personales o, en su caso, si lo hace un tercero acreditar la representación legal;
e) La descripción clara y precisa de los datos personales respecto de los que se busca ejercer alguno de los derechos de ARCO; y
f) Cualquier otro elemento o documento que facilite la localización de sus Datos Personales;
g) En su caso, las solicitudes de rectificación de datos personales, el titular deberá indicar las modificaciones a realizarse y aportar la documentación que sustente su petición. En caso de faltar alguna información en su solicitud se le solicitará subsane la omisión a la
brevedad.
Si existe duda de su identidad, PENÍNSULA se reserva el derecho a solicitar cualquier otro documento para comprobar su identidad. Si cumpliera con todas las formalidades requeridas para dicho trámite se dará respuesta en un plazo máximo de veinte días, contados a partir de la fecha en que se recibió su petición o a partir de la fecha en que haya subsanado en su totalidad las prevenciones. El plazo antes referido podrá ser ampliado una sola vez por un periodo igual, siempre y cuando así lo justifiquen las circunstancias del caso, de conformidad con el artículo 32 de la LFPDPPP. Es importante que tenga en cuenta que no en todos los casos podremos atender su solicitud o concluir el uso de forma inmediata, ya que es posible que por alguna obligación legal requiramos seguir tratando sus datos personales. VII. EN SU CASO, LAS TRANSFERENCIAS DE DATOS QUE SE EFECTÚEN.
Le hacemos de su conocimiento que PENÍNSULA si realiza transferencias de datos personales a terceros. Además, se podrán realizar transferencias sin su consentimiento de acuerdo a lo previsto en el artículo 37 de la LFPDPPP, así como a realizar esta transferencia en los términos que fija la ley, a lo que establecemos lo supuesto:
a) Cuando la transferencia esté prevista en una Ley o Tratado en los que México sea parte;
b) Cuando la transferencia sea necesaria para la prevención o el diagnóstico médico, la prestación de asistencia sanitaria, tratamiento médico o la gestión de servicios sanitarios;
c) Cuando la transferencia sea efectuada a sociedades controladoras, subsidiarias o afiliadas bajo el control común del responsable, o a una sociedad matriz o a cualquier
sociedad del mismo Grupo del responsable que opere bajo los mismos procesos y políticas internas;
d) Cuando la transferencia sea necesaria por virtud de un contrato celebrado o por celebrar en interés del titular, por el responsable y un tercero;
e) Cuando la transferencia sea necesaria o legalmente exigida para la salvaguarda de un interés público, o para la procuración o administración de justicia;
f) Cuando la transferencia sea precisa para el reconocimiento, ejercicio o defensa de un derecho en un proceso judicial; y
g) Cuando la transferencia sea precisa para el mantenimiento o cumplimiento de una relación jurídica entre el responsable y el titular.
VIII. REVOCACIÓN DE SU CONSENTIMIENTO AL TRATAMIENTO DE DATOS PERSONALES.

a) The name of the owner of the personal data:
b) The domicile of the owner and, if applicable, the domicile
of the legal representative;
c) An alternate means of communicating the response to your request;
d) The documents proving the identity of the holder of the personal data or, if applicable, if a third party does it, proving the legal representation;
e) A clear and precise description of the personal data with respect to which the exercise of any of the ARCO rights is sought; and
f) Any other element or document that facilitates the location of your Personal Data;
g) In the case of requests for rectification of personal data, the holder must indicate the changes to be made and provide documentation to support his request. If any information is missing in your request, you will be asked to correct the omission as soon as possible

If there is any doubt as to your identity, PENINSULA reserves the right to request any other document to verify your identity. If you comply with all the formalities required for such processing, a response will be given within a maximum period of twenty days, counted from the date on which your request was received or from the date on which you have fully complied with the provisions. The aforementioned term may be extended only once for an equal period, provided that the circumstances of the case so justify, in accordance with Article 32 of the LFPDPPP. It is important to note that not in all cases we will be able to fulfill your request or terminate the use immediately, as we may be required by law to continue processing your personal data. You should also consider that, for certain purposes, revoking your consent will mean that we will no longer be able to provide you with the service you requested, or that your relationship with us will be terminated. VII. WHERE APPROPRIATE, THE DATA TRANSFERS TO BE CARRIED OUT.
We inform you that PENINSULA does transfer personal data to third parties. In addition, transfers may be made without your consent in accordance with the provisions of Article 37 of the LFPDPPP, as well as to make this transfer under the terms set forth in the law, to which we establish the assumption:
a) When the transfer is provided for in a Law or Treaty to which Mexico is a party;
b) When the transfer is necessary for prevention or medical diagnosis, the provision of health care, medical treatment or the management of health services;
c) When the transfer is made to controlling companies, subsidiaries or affiliates under the common control of the responsible party, or to a parent company or to any of the following: a) When the transfer is made to a subsidiary, subsidiary or affiliate under the common control of the responsible party, or to a parent company or to any of the following
company of the same Group of the responsible party that operates under the same internal processes and policies;
d) When the transfer is necessary by virtue of a contract entered into or to be entered into in the interest of the owner, by the person in charge and a third party;
e) When the transfer is necessary or legally required for the safeguarding of a public interest, or for the procurement or administration of justice;
f) When the transfer is necessary for the recognition, exercise or defense of a right in a judicial proceeding; and
g) When the transfer is necessary for the maintenance or fulfillment of a legal relationship between the controller and the holder.
VIII. REVOCATION OF YOUR CONSENT TO THE PROCESSING OF PERSONAL DATA.
You may revoke the consent that, if applicable, you have given us for the processing of your personal data, so please send your request to the Personal Data Protection Officer by e-mail to: info@peninsula.mx .
